General conditions of sale

ARTICLE 1: BIDDING

In order to request a bidder’s approval, the potential bidder must register on the platform dedicated to the Château Bacon sale. This platform is managed in collaboration between Château Bacon and ClipMyHorse. The person wishing to bid will receive a personal access code enabling him/her to bid in a secure manner.

To be able to bid, these general terms and conditions of sale must have been validated by the bidder.

An effective bid must correspond to the minimum bid and, in addition, at least one bidding step above the previous bidder’s bid; All bids are indicated in Euros and bids are made in increments of 1,000 for all horses entered in the auction. The bidder will be informed by email if his bid is accepted and also if he has been outbid.

Any person who places bids is deemed to place bids for himself unless he is the bearer of a written power of attorney from the person on whose behalf he placed the bids. The proxy will be responsible for its purchase in case of default of the principal.

The costs to be borne by the purchaser are 10% exclusive of tax on the amount of the last bid. The VAT that will apply will depend on the country of destination of the horse (20% if the horse is intended to stay in France).

In the event of export to a country other than France, the price will be indicated exclusive of tax and the taxes relating to national regulations will be the responsibility of the Buyer who will pay them to the customs of the country of import.

 

ARTICLE 2: PAYMENT AND TRANSFER OF OWNERSHIP

The sales organization is SVV Bordeaux-Chartrons, Bordeaux Enchères, numéro d’agrément 2002 351, situé au 136 quai des Chartrons – 33 300 Bordeaux

Auctions are held against immediate cash payment.

The bidder by the sole fact of his bid engages his financial responsibility to the seller.

The sale is perfect between the parties as soon as the bid is finalized.

A sales slip including the price of the auction as well as the costs of the said auction will be sent on Monday 14 December.

The sales slip will be issued by the SVV Bordeaux-Chartrons.

The property is acquired by the Buyer from the Seller at the time of payment of the sales slip in full, the Seller reserving ownership of the horse until full payment. This clause prevents the resale by the Buyer as long as the sales slip is not paid.

However, the risks concerning the horse are at the charge of the Buyer as soon as the bid is validated.

Payment must be made within 48 hours following the auction by bank transfer :

Any non-payment suspends the obligations of the Seller.

Each week of delay will result in the application of a penalty of 2% per week exceeded.

The Seller will give to the Buyer, at the time of full payment, the accompanying documents of the horse.

 

ARTICLE 3: VETERINARY FILE 

X-ray examinations and a complete clinical check-up were performed for each horse presented for sale. These elements are available on the website ClipMyHorse in each horse presentation sheet.

The buyer, by bidding, certifies having read the veterinary elements (X-rays, clinical visit report), certifies having possibly had them read again to his veterinarian and accepts the horse with all its file.

ARTICLE 4: EXTERNAL ADVICE

Before bidding, the buyer can ask for advice from an external third party (coach…) on the adequacy between his riding and the horse to be acquired. Whether or not the customer calls upon an advisor, the Seller cannot be held responsible, following the sale, for a poor match between the equestrian level of the rider, his sporting objectives and the horse’s aptitudes.

 

ARTICLE 5: DELIVERY

The buyer must recover the horse at his own expense within 7 days of the sale.
The buyer must undertake to insure the horse from the moment when the sale is perfect until the transfer of ownership “effective” when he collects the horse.

 

ARTICLE 6: TESTING OF HORSES

The buyer, before the sale, is free to come and try or see the horse and take all the necessary information during a meeting with the seller.

Following the sale, no reason can be used to cancel the sale or return the horse.

 

ARTICLE 7: DISPUTES:

The sales are made with the legal guarantee of the rural code.

Disputes that may arise concerning the validity, interpretation, performance or non-performance, interruption or termination of this contract will be submitted to mediation in accordance with the Mediation Rules of the GHN Mediation Center.
